1. Who is responsible for your data

The data controller for gymfuel.ie is Freshways Food Co, Poppintree, Finglas, Dublin 11, D11 F851, Ireland — telephone 01 864 8000. The website is built and maintained on Freshways’ behalf by Engage Media Solutions, which acts as a data processor.

2. What we collect and why

Trade and stockist enquiries. When you send the enquiry form we collect the details you type — business name, your name, email address, phone number, business type, county, estimated volume and your message. We also automatically record the date and time, the IP address the enquiry came from and the country it resolves to, which we use to block spam and abuse.

We use this to reply to you, to arrange supply and to keep a record of the conversation. We do not sell it, rent it, or share it with third parties for their own marketing, and we do not add you to a mailing list off the back of an enquiry.

Website use. We do not run advertising trackers, we do not profile you and we do not track you across other websites. If we add analytics in future it will be aggregate and cookie-free, and this notice will be updated before it goes live.

3. Our lawful basis

Under Article 6 of the GDPR we rely on:

• Legitimate interests — responding to a business enquiry you chose to send us, and protecting the site from spam.
• Contract — where the enquiry leads to supplying you, to set up and service the account.
• Legal obligation — where we have to keep records, for example for tax or food safety.

4. Cookies

This site sets no advertising, tracking or analytics cookies, which is why you are not being asked to accept any. The only technical data involved is what any web server necessarily sees to deliver a page.

5. Who processes it for us

We use a small number of suppliers to run the site. They act on our instructions only:

• Cloudflare, Inc. — website hosting, security and email forwarding.
• Resend (Plus Five Five, Inc.) — sending the enquiry notification and your confirmation email.
• Google LLC — Google Fonts serves the typefaces, which means Google receives your IP address as part of delivering the font files; and Gmail, where enquiry emails are received.

Some of these are based outside the European Economic Area. Where data leaves the EEA it is protected by the European Commission’s Standard Contractual Clauses and, for US suppliers, the EU–US Data Privacy Framework.

6. How long we keep it

Enquiries that do not lead anywhere are deleted within 24 months. Where you become a customer, we keep the records for the life of the account and then for six years afterwards, as required for tax and accounting. Spam-blocking data such as IP addresses is deleted within 12 months.

7. Your rights

Under GDPR you have the right to:

• be told what personal data we hold about you and get a copy of it
• have inaccurate details corrected
• have your data deleted — the “right to be forgotten”
• restrict or object to how we use it, including objecting to our legitimate interests
• receive your data in a portable format
• withdraw consent at any time, where consent is what we relied on

Email [email protected] and we will action it within one month, free of charge. We may need to confirm who you are first.

We do not use automated decision-making or profiling, and the site is not intended for children.

8. Complaints

If you are unhappy with how we have handled your data, please tell us first so we can put it right. You also have the right to complain to the Irish supervisory authority: Data Protection Commission, 6 Pembroke Row, Dublin 2, D02 X963 — 01 765 0100 — dataprotection.ie.
